  Guidelines on personal injury claims now in place


KUALA  LUMPUR: There was a time when a claimant with a fractured thigh bone might get RM50,000 in damages in a court in Pahang while someone with a similar fracture might get RM18,000 here.
But those days of inconsistent personal injury awards are no more.
A Compendium of Personal Injury Claims, drafted by the Malaysian Bar and approved by the Judiciary, was introduced in the courts in January as a guide for judges and lawyers.
This had led to:
> Less time wasted in arguing the quantum;
>Greater uniformity in awards; and
The compendium is not meant to:
>Stifle the rights of claimants or insurance companies in asking for lower or higher than the stipulated quantum; or
> Fetter the court`s discretion.
